1. Scope and Subject Matter
These Terms of Use govern the use of the mobile application "Barber App" of the MVM-APP brand and the associated technical and web-based features.
This includes in particular:
- User accounts and profiles
- Barber and salon profiles
- Appointment and booking functions
- Public web profiles
- Web booking requests
- Chat and communication functions
- Reviews
- Vouchers and loyalty programmes
- Widgets
- QR code, link and PDF sharing
- Support and reporting functions
By registering, installing or using the Barber App, the user accepts these Terms of Use.
The Barber App provides a digital platform for managing user profiles, displaying barber and salon profiles, showing services and prices, and organising appointment requests. Use of the app is only permitted for lawful purposes.

3. Role of the Platform
The Barber App is a technical intermediary, organisation and communication platform. Unless expressly stated otherwise, the operator provides only the technical infrastructure. The operator does not generally become a party to contracts for services concluded between customers and hairdressers, barbers or salons.
Contracts for hairdressing services — in particular regarding appointments, prices, scope of services, rescheduling, cancellations, vouchers and salon-related services — are concluded exclusively between the users involved.
The operator is neither a vicarious agent nor a contracting party to these service relationships.
4. Registration, User Account and Accurate Information
A user account is required to use the key features of the Barber App. The user undertakes to provide truthful, complete and current information when registering and using the app — in particular regarding name, email address and other profile information requested.
The operator is entitled to unlock certain features only after verification, in particular after email verification or comparable security measures. Changes to personal data must be updated immediately by the user in the app.
There is no entitlement to registration or permanent maintenance of a user account.
5. Eligible Users and Minimum Age
Use of the Barber App is only permitted to persons who are authorised to use it under applicable law. Use is generally intended only for persons who have completed their 14th year of age.
Minors may only use the app in accordance with legal requirements and, where necessary, with the consent of their legal guardians.
6. User Roles
The app can be used in particular by the following user groups:
- Customers
- Hairdressers / Barbers
- Salon owners
- Salon staff
Hairdressers, barbers, salon owners and salon staff are themselves responsible for the accuracy, completeness and lawfulness of their information — in particular regarding services offered, prices, availability, profile information, gallery and portfolio content, as well as voucher and loyalty programme details.
The operator does not guarantee that services offered will actually be provided or will meet a certain quality standard.
7. Scope of App Features
The Barber App may provide the following features in particular:
- Registration and login
- Profile management
- Barber and salon profiles
- Service management
- Appointment requests and appointment management
- Web booking requests
- Status updates
- Chat communication
- Push notifications
- Reviews and favourites
- Vouchers and loyalty programmes
- Image uploads (profile pictures, gallery, chat attachments)
- iOS widgets
- Support and reporting functions
- QR code, link and PDF sharing
The specific scope of features may change as part of technical, organisational or legal developments. There is no entitlement to a specific feature or its permanent availability.
8. Permitted Use and User Obligations
All users undertake to use the app exclusively in accordance with applicable law and these Terms of Use.
In particular, it is prohibited to distribute content or carry out actions via the app that are unlawful, offensive, discriminatory, racist, glorifying violence, pornographic, fraudulent, misleading, harassing or otherwise inappropriate.
The following are also prohibited in particular:
- Spam and mass sending of unsolicited messages
- Automated mass access, scraping or bots (unless expressly permitted)
- Circumventing technical protective measures
- Manipulation of profiles, appointments, vouchers or reviews
- Abusive multiple accounts
- Attacks on the availability, integrity or security of the platform
9. Account Security
Every user is obliged to keep their access data confidential and protect it from unauthorised access. In particular:
- Passwords must not be shared with third parties.
- Access data must be changed immediately if misuse is suspected.
- Security incidents should be reported to the operator without delay.
In the event of suspected misuse, security breaches or unauthorised use, the operator may take appropriate protective measures, in particular additional verifications, restrictions or suspensions.
10. Appointments, Bookings and Organisational Responsibility
Appointments and appointment requests created, modified or displayed via the app or associated web functions serve to coordinate between users. The following information may be processed in particular: date and time, service, price, status, notes, users involved and, where applicable, voucher information.
Creating an appointment or appointment request does not constitute a guarantee that a service will be agreed upon or carried out. Hairdressers, barbers or salons may decline, reschedule or adjust requests.
Disputes regarding services, quality, delays, cancellations, payments or voucher matters are generally outside the operator's responsibility.
11. Prices, Payments and Commercial Relationships
Prices and service details within barber or salon profiles are generally the responsibility of the respective hairdressers, barbers or salons.
Where the app does not provide its own payment processing, the operator assumes no responsibility in particular for:
- Payment processing between customer and hairdresser / barber / salon
- Collections, refunds or invoicing
- Tax treatment
- Out-of-court or judicial enforcement of claims
12. Chat Function and Communication Rules
The chat function serves for direct communication between customers and hairdressers / barbers / salons, in particular in connection with appointments, enquiries and salon-related matters. Users undertake to communicate respectfully, factually and for the intended purpose.
The following are prohibited in particular: spam, off-topic advertising, insults, threats or harassment, unlawful content, fraudulent or deceptive requests, and abusive contact.
Users can report chats or other content to support via the functions provided. The operator is entitled to review reported content within the framework of legal requirements and take appropriate measures (warnings, restrictions, suspensions, removal of impermissible content), where legally permissible and technically possible.
13. Image Uploads and User-Generated Content
The app may allow the uploading of content, in particular: profile pictures, gallery and portfolio images, salon logos and chat image attachments.
The user warrants that:
- they hold the necessary rights to the uploaded content,
- no third-party rights are infringed, and
- no unlawful or inappropriate content is uploaded.
The user grants the operator a simple, non-exclusive right, limited to the duration of use, to store, process, copy and display this content within the app, to the extent necessary for the provision of the service.
The operator is entitled to block, hide or remove content in the event of violations of these Terms of Use.
14. Reviews and Ratings
The app may allow users to rate barbers, salons or services. Reviews must be factual, truthful, not misleading and free of unlawful content.
The following are not permitted in particular:
- Fake reviews
- Offensive, defamatory or reputation-damaging content
- Reviews without actual usage context (where technically verifiable)
- Targeted manipulation of the review system
The operator reserves the right to review, hide or remove reviews in the event of violations.
15. Vouchers, Loyalty Programmes and Offers
The app may allow barbers or salons to provide vouchers, discount promotions or loyalty programmes. The content, terms, value, duration, availability, redeemability and accuracy of such offers are the sole responsibility of the respective barber or salon.
The operator does not guarantee that vouchers or loyalty benefits will actually be granted, recognised or redeemed outside the terms displayed in the app.
Misuse, multiple redemptions in circumvention of technical rules or other manipulation are not permitted.
16. Public Profiles and Sharing Functions
The app may provide public barber or salon profiles, website profiles, QR codes, web links or PDF sharing. Barbers and salons are responsible for ensuring that the information they publicly display is lawful, accurate, up to date and free of third-party rights.
The operator makes no warranty regarding the commercial effect of such profiles, their findability, external impact or business success.
17. Suspension, Restriction and Deletion of User Accounts
The operator is entitled to temporarily restrict, suspend or permanently delete user accounts, in particular if:
- these Terms of Use are violated,
- false, misleading or abusive information is provided,
- there is suspicion of misuse or security breach,
- the integrity or security of the platform is endangered,
- legal obligations require it, or
- technical or operational reasons make it necessary.
Where possible and reasonable, the user will be informed of material measures.
18. Availability and Technical Changes
The operator endeavours to operate the app in a stable and secure manner, but does not guarantee availability at all times and without interruption. Restrictions may occur in particular due to: maintenance work, technical faults, server outages, failures of external services, synchronisation delays or delayed or absent notifications.
The operator is not liable for mere availability interruptions, unless mandatory statutory liability exists.
19. Liability
The operator is liable under statutory provisions in cases of intent and gross negligence, injury to life, body or health, and cases of mandatory statutory liability.
In cases of minor negligence, the operator is only liable for breach of material contractual obligations and limited to the foreseeable, typically occurring damage.
Liability for content, information and services of hairdressers, barbers or salons, and for agreements concluded between users, is excluded to the extent permitted by law.
20. Account Deletion
Users may generally delete their account at any time using the functions provided, or request deletion. Upon deletion, the user loses access to their profile and app-related functions. Restoration of fully deleted data is generally not possible.
The processing of personal data under data protection law is additionally governed by the Privacy Policy.
21. Technical Third-Party Services
The Barber App uses technical services and infrastructure from third parties, in particular for:
- Authentication
- Data storage and synchronisation
- Push notifications
- Image storage
- Technical web functions
- System and security communication
This may include services from Firebase / Google as well as other technical providers. Further information can be found in the Privacy Policy.
22. Changes to the Terms of Use
The operator reserves the right to update these Terms of Use, in particular due to technical developments, changes in legal requirements, changes to the scope of features, or security or operational requirements.
Users will be informed of material changes in an appropriate manner. Continued use of the app after changes come into effect may be deemed acceptance, to the extent permitted by law.
23. Severability
If any provision of these Terms of Use is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the applicable statutory rule.
24. Applicable Law
The law of the Republic of Austria applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions of the country in which the user has their habitual residence preclude this.
