Terms of Use for the Barber App (Android) - MVM-APP

1. Scope and Subject Matter of the Contract
These Terms of Use govern the use of the mobile application “Barber-App” under the MVM-APP brand and related technical functions (e.g., in-app appointment organization, communication, widgets, and public profile features).
By registering, installing, or using the Barber App, the user accepts these Terms of Use.
The Barber App provides a digital platform through which, in particular, users can:
manage user profiles,
display barber profiles and services,
organize appointment requests and appointments,
carry out communication processes between customers and barbers,
and (if enabled) use widgets to display certain overviews.
The operator provides only the technical infrastructure and is generally not a contractual party to service agreements concluded between customers and barbers.
Use of the app is permitted only for lawful purposes.

3. Registration, Account, and Accurate Information
A user account is required to use essential functions of the Barber App.
When registering and using the app, the user undertakes to provide:
truthful,
complete, and
up-to-date information
This applies in particular to name, email address and, where requested, city/place of residence as well as other profile information.
The operator is entitled to enable certain functions only after verification (e.g., email verification).
Changes to personal data must be updated by the user in the app without undue delay.
4. Permitted Users and Minimum Age
The Barber App may only be used by persons who are legally permitted to use it under applicable law.
The app is intended only for persons aged 14 and older. Minors may use the app only within the scope of applicable law and, where required, with the consent of their legal guardians.
5. User Roles (Customers / Barbers / Salons)
The app may be used by different user groups, in particular:
Customers
Hairdressers / Barbers
Salon owners / salon staff
Hairdressers, salon owners, and staff are solely responsible for the accuracy and completeness of their information, in particular regarding:
offered services
prices
availability
profile information
gallery/portfolio content
other salon-related information
The operator gives no warranty that offered services will actually be performed or meet a particular quality standard.
6. Role of the Platform / No Contracting Party for Hairdresser Services
The Barber App is a technical mediation and organization platform.
Contracts for hairdresser services (e.g., appointment arrangements, price agreements, scope of services, cancellations) are concluded exclusively between the participating users (customer and hairdresser/salon).
The operator is neither a vicarious agent nor a contractual partner in these service relationships.
7. Scope of App Services
The Barber App may provide the following functions in particular:
Registration and sign-in
Profile management
Hairdresser/salon profiles
Service management
Appointment requests and appointment management
Status updates
Chat communication
Push notifications
Ratings / reviews
Image uploads (e.g., profile pictures, gallery, chat attachments)
Android widgets for displaying overviews (e.g., appointments/booking requests), if activated by the user
Support/report features (e.g., reporting chats/content and displaying support responses in the app)
The specific range of functions may change as part of technical development.
The operator reserves the right to modify, add, or remove functions, provided this does not result in an unreasonable disadvantage to users.
There is no claim to a specific function or to permanent availability of individual system components.
8. User Obligations and Permitted Use
All users undertake to use the app solely in accordance with applicable law and these Terms of Use.
In particular, it is prohibited to distribute content or perform actions via the app that are:
unlawful,
offensive,
discriminatory,
racist,
glorifying violence,
pornographic,
fraudulent,
misleading
or otherwise inappropriate.
Use of the app for abusive purposes is prohibited, in particular:
spam
mass sending of unsolicited messages
bypassing technical protection measures
manipulation of profiles, appointments, or ratings
automated mass access (scraping/bots), unless expressly permitted
overload attacks or security-threatening interference
9. Account Security and Login Credentials
Each user is required to keep login credentials confidential and protect them from unauthorized access.
In particular:
Passwords must not be shared with third parties.
If misuse is suspected, login credentials must be changed immediately.
Security incidents should be reported to the operator.
The operator may take temporary protective measures in cases of suspected misuse, security breaches, or unauthorized use (e.g., suspension, additional verification).
10. Chat Function, Communication Rules, and Reports
The chat function is intended for direct communication between customers and barbers in connection with appointments, follow-up questions, and salon-related matters.
Users undertake to communicate:
respectfully,
factually, and
for the intended purpose.
In particular, the following are prohibited:
spam
advertising outside the app’s purpose
insults, threats, harassment
unlawful content
fraudulent requests
Message content is stored to provide the chat function. The operator accesses content only where technically necessary or legally required.
Users can report chats or content to support using the provided functions (e.g., due to spam or inappropriate content). The operator is entitled to review reported content within the scope of applicable law and these Terms of Use and to take appropriate measures (e.g., warnings, restrictions, suspensions, or removal of content where permitted).
Support responses to reports may be provided within the app.
11. Image Uploads (Profile Photo, Gallery, Chat Images)
The app may allow users to upload images (e.g., profile pictures, gallery/portfolio photos, chat image attachments).
The user warrants that:
they have the necessary rights to the uploaded content,
the use of the content does not infringe third-party rights (in particular copyright, personality, or trademark rights),
no unlawful or inappropriate content is uploaded.
The user grants the operator a simple, non-exclusive right of use limited to the duration of use to technically store, process, and display the content within the app insofar as necessary to provide the functions.
The operator is entitled to remove or block content in the event of violations of these Terms of Use.
12. Ratings and Reviews
The app may allow users to rate hairdressers and/or services.
Ratings must be:
objective,
truthful,
not misleading
and free from unlawful content.
The following are inadmissible in particular:
fake reviews
insulting or defamatory content
reviews without an actual usage context (where technically verifiable)
targeted manipulation of rating systems
The operator reserves the right to review, hide, or remove ratings in the event of violations.
13. Appointment Organization and Responsibility
Appointments and appointment requests created, modified, or displayed via the app serve organizational coordination between users.
Users acknowledge that the following data may in particular be displayed and processed within the app:
date/time
price information
service
status
notes
participating users
Creating an appointment or appointment request does not constitute a guarantee that a service will be concluded or performed.
Hairdressers may reject requests or adjust appointments, but are obliged to communicate this transparently.
Disputes regarding services, quality, delays, cancellations, or payment issues are generally outside the operator’s responsibility.
14. Prices, Payments, and Commercial Relationships
Prices and service information within hairdresser/salon profiles are generally the responsibility of the respective hairdressers/salons.
As long as the app does not provide its own payment processing, the operator assumes no responsibility in particular for:
payment processing between customer and hairdresser
debt collection
refunds
invoicing by hairdressers/salons
15. Suspension, Restriction, and Deletion of User Accounts
The operator is entitled to temporarily restrict, suspend, or permanently delete user accounts, in particular if:
these Terms of Use are violated,
false or misleading information is provided,
there is suspicion of security issues or misuse,
the integrity or security of the platform is endangered,
legal obligations require such action.
Where possible and reasonable, the user will be informed of significant measures.
16. Availability and Technical Changes
The operator strives for stable operation of the app but does not guarantee continuous and uninterrupted availability at all times.
In particular, the following may occur:
maintenance work
technical faults
server outages
failures of external services
delays in synchronizations or notifications
The operator is not liable for mere availability interruptions unless mandatory statutory liability applies.
17. Liability
The operator is liable in accordance with statutory provisions:
in cases of intent and gross negligence,
for injury to life, body, or health,
and in cases of mandatory statutory liability.
In cases of slight negligence, the operator is liable only for breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable, typical damage.
Liability for content and services of hairdressers/salons and for agreements concluded between users is excluded to the extent permitted by law.
18. Account Deletion and Data Removal
Users may generally delete their account at any time.
Upon deletion, the user loses access to their profile and app-related functions. Personal data is removed within the limits of technical feasibility, unless statutory retention obligations prevent this.
Restoration of fully deleted data is generally not possible.

19. Use of Firebase (Google)
The Barber App uses technical services from Firebase (Google), in particular for:
authentication
data storage
synchronization
notifications
image storage
Firebase is not a provider of hairdresser services, but provides technical infrastructure.

20. Changes to the Terms of Use
The operator reserves the right to amend these Terms of Use, in particular in the event of:
technical developments,
changes in legal requirements,
changes in the scope of functions,
security or operational requirements.
Users will be informed of significant changes in an appropriate manner (e.g., within the app). Continued use of the app after the changes take effect may be deemed consent, to the extent legally permissible.
21. Severability Clause
If any provision of these Terms of Use is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions remains unaffected.
The statutory provision shall replace the invalid provision.
22. Applicable Law
The law of the Republic of Austria applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection provisions of the state in which the user has their habitual residence provide otherwise.
