1. Scope and Subject Matter
These Terms of Use govern the use of the mobile application "Barber App" of the MVM-APP brand and the associated technical features and web functions, in particular public barber profiles, web booking requests, communication functions, Android widgets and QR/PDF sharing.
By registering, installing or using the Barber App, the user accepts these Terms of Use.
The Barber App provides a digital platform for in particular:
- managing user profiles,
- displaying barber and salon profiles,
- showing services and prices,
- organising appointment requests and appointments,
- enabling communication between customers and hairdressers,
- submitting reviews,
- managing vouchers, loyalty programmes and barber offers, and
- using additional technical features such as Android widgets, QR codes or PDF sharing.
The operator generally provides the technical infrastructure and, unless expressly otherwise agreed, does not become a party to service contracts concluded between customers and hairdressers or salons. Use of the app is only permitted for lawful purposes.

3. Registration, Account and Accurate Information
A user account is required to use the key features of the Barber App. The user undertakes to provide truthful, complete and current information when registering and using the app — in particular name, email address and other profile information requested.
The operator is entitled to unlock certain features only after verification, in particular email verification. Changes to personal data must be updated by the user immediately in the app.
4. Eligible Users and Minimum Age
Use of the Barber App is only permitted to persons who are authorised to use it under applicable law. Use is only intended for persons aged 14 and over.
Minors may only use the app in accordance with legal requirements and, where necessary, with the consent of their legal guardians.
5. User Roles
The app can be used in particular by the following user groups:
- Customers
- Hairdressers / Barbers
- Salon owners / Salon staff
Hairdressers, salon owners and staff are themselves responsible for the accuracy and completeness of their information — in particular regarding services offered, prices, availability, profile information, gallery/portfolio content, voucher and loyalty programme details, and other salon-related information.
The operator does not guarantee that services offered will actually be provided or will meet a certain quality standard.
6. Role of the Platform
The Barber App is a technical intermediary and organisation platform. Contracts for hairdressing services — in particular appointment arrangements, pricing agreements, scope of services, cancellations or other salon-related services — are concluded exclusively between the users involved.
The operator is neither a vicarious agent nor a contracting party to these service relationships.

The Barber App may provide the following features in particular:
- Registration and login
- Profile management
- Barber/salon profiles
- Service management
- Appointment requests and appointment management
- Web booking requests
- Status updates
- Chat communication
- Push notifications
- Reviews / ratings
- Favourites
- Vouchers and loyalty programmes
- Image uploads (profile pictures, gallery, chat attachments)
- Android widgets for displaying overviews
- Support/reporting functions
- QR code, link and PDF sharing for barber profiles
The specific scope of features may change as part of technical developments. The operator reserves the right to adjust, add or remove features, provided this does not unreasonably disadvantage users. There is no entitlement to a specific feature or permanent availability of individual system components.
8. User Obligations and Permitted Use
All users undertake to use the app exclusively in accordance with applicable law and these Terms of Use.
In particular, it is prohibited to distribute content or carry out actions via the app that are unlawful, offensive, discriminatory, racist, glorifying violence, pornographic, fraudulent, misleading or otherwise inappropriate.
Use of the app for abusive purposes is prohibited, in particular:
- Spam and mass sending of unsolicited messages
- Circumventing technical protective measures
- Manipulation of profiles, appointments, vouchers or reviews
- Automated mass access, scraping or bots (unless expressly permitted)
- Overload attacks or other security-compromising interference
9. Account Security and Access Data
Every user is obliged to keep access data confidential and protect it from unauthorised access. In particular:
- Passwords must not be shared with third parties.
- Access data must be changed immediately if misuse is suspected.
- Security incidents should be reported to the operator.
In the event of suspected misuse, security breaches or unauthorised use, the operator may take temporary protective measures, in particular restrictions, suspensions or additional verifications.
10. Chat Function, Communication Rules and Reports
The chat function serves for direct communication between customers and hairdressers in connection with appointments, enquiries and salon-related matters. Users undertake to communicate respectfully, factually and for the intended purpose.
The following are prohibited in particular: spam, off-topic advertising, insults, threats or harassment, unlawful content, and fraudulent or deceptive requests.
Users can report chats or content to support via the functions provided. The operator is entitled to review reported content within the framework of legal requirements and take appropriate measures (warnings, restrictions, suspensions, removal), where legally permissible. Support responses to reports may be provided within the app.
11. Image Uploads
The app may allow the uploading of images, in particular: profile pictures, gallery/portfolio images, and chat image attachments.
The user warrants that:
- they hold the necessary rights to the uploaded content,
- no third-party rights are infringed, and
- no unlawful or inappropriate content is uploaded.
The user grants the operator a simple, non-exclusive right of use, limited to the duration of use, to store, process and display the content within the app and associated functions, to the extent necessary for the provision of the features.
The operator is entitled to remove or block content in the event of violations of these Terms of Use.
12. Reviews and Ratings
The app may allow users to rate barbers or services. Reviews must be factual, truthful, not misleading and free of unlawful content.
The following are not permitted in particular:
- Fake reviews
- Offensive or defamatory content
- Reviews without actual usage context (where technically verifiable)
- Targeted manipulation of rating systems
The operator reserves the right to review, hide or remove reviews in the event of violations.
13. Vouchers, Loyalty Programmes and Offers
The app may allow barbers to provide vouchers, discount promotions or loyalty programmes. The content, terms, value, duration, redeemability and accuracy of such offers are the sole responsibility of the respective barber or salon.
The operator does not guarantee that vouchers or loyalty benefits will actually be granted, recognised or redeemed outside the terms displayed in the app.
Misuse, multiple redemptions in circumvention of technical rules or other manipulation are not permitted.
14. Appointment Organisation and Responsibility
Appointments and appointment requests created, modified or displayed via the app or website serve to coordinate between users. The following information may be displayed in particular: date and time, price information, service, status, notes, users involved and, where applicable, voucher information.
Creating an appointment does not constitute a guarantee that a service will be agreed upon or carried out. Hairdressers may decline requests or adjust appointments, but are obliged to communicate this transparently.
Disputes regarding services, quality, delays, cancellations, payments or voucher matters are generally outside the operator's responsibility.
15. Prices, Payments and Commercial Relationships
Prices and service details within barber/salon profiles are generally the responsibility of the respective hairdressers or salons.
Where the app does not provide its own payment processing, the operator assumes no responsibility in particular for:
- Payment processing between customer and hairdresser
- Collections and refunds
- Invoicing
- Tax treatment by hairdressers or salons
16. Public Profiles, Website and Sharing Functions
The app may provide public barber profiles, website profiles, QR codes, web links or PDF sharing. Barbers are responsible for ensuring that the information they publicly display is lawful, accurate and up to date.
The operator makes no warranty regarding the commercial effect, findability or external impact of such profiles or shares.
17. Suspension, Restriction and Deletion of User Accounts
The operator is entitled to temporarily restrict, suspend or permanently delete user accounts, in particular if:
- these Terms of Use are violated,
- false or misleading information is provided,
- there is suspicion of misuse or security breach,
- the integrity or security of the platform is endangered, or
- legal obligations require it.
Where possible and reasonable, the user will be informed of material measures.
18. Availability and Technical Changes
The operator endeavours to operate the app in a stable manner, but does not guarantee availability at all times and without interruption. The following may occur in particular: maintenance work, technical faults, server outages, failures of external services, and delays in synchronisations or notifications.
The operator is not liable for mere availability interruptions, unless mandatory statutory liability exists.
19. Liability
The operator is liable under statutory provisions in cases of intent and gross negligence, injury to life, body or health, and cases of mandatory statutory liability.
In cases of minor negligence, the operator is only liable for breach of material contractual obligations and limited to the foreseeable, typically occurring damage.
Liability for content and services of hairdressers/salons and for agreements concluded between users is excluded to the extent permitted by law.
20. Account Deletion
Users may generally delete their account at any time. Upon deletion, the user loses access to their profile and app-related functions. Restoration of fully deleted data is generally not possible.

21. Firebase and Technical Third-Party Services
The Barber App uses technical services, in particular from Firebase/Google, for example for:
- Authentication
- Data storage and synchronisation
- Push notifications
- Image storage
- Technical web functions
These services are used exclusively for the technical operation of the app and website. Further information:

22. Changes to the Terms of Use
The operator reserves the right to update these Terms of Use, in particular due to technical developments, changes in legal requirements, changes to the scope of features, or security or operational requirements.
Users will be informed of material changes in an appropriate manner. Continued use of the app after changes come into effect may be deemed acceptance, to the extent permitted by law.
23. Severability
If any provision of these Terms of Use is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the applicable statutory rule.
24. Applicable Law
The law of the Republic of Austria applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions of the country in which the user has their habitual residence preclude this.
