These terms of use were originally written in German. In case of discrepancies between the German original and this translation, the German version shall prevail.
1. Scope of Application and Consent
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and Marcel Salimovic ("Provider") regarding the use of the mobile application "MVM Shift Planner" ("App").
By downloading, installing or using the App you agree to these Terms. If you do not agree to these Terms, you must uninstall the App immediately.
2. Licence & Scope of Use
Subject to your compliance with these Terms, the Provider grants you a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes on Apple devices that you own or control.
The following is prohibited:
- Reverse engineering or decompiling the App.
- Using the App to harass or harm other persons.
- Using automated systems (bots) to access the App.
- Renting, leasing or reselling the App.
3. MVM Pro Subscriptions
The App offers optional paid features under the name "MVM Pro".
A. Payment Processing
All payments are processed exclusively by Apple Inc. via the App Store. The Provider does not process payments and does not store any financial data. Apple Media Services Terms and Conditions apply.
B. Automatic Renewal
Subscriptions renew automatically unless auto-renewal is disabled at least 24 hours before the end of the current period. Your iTunes account will be charged within 24 hours before the end of the current period.
C. Cancellation
You can manage and cancel your subscriptions in your App Store account settings. Simply deleting the App does not cancel the subscription.
4. AI Features & Disclaimer
The App includes an AI assistant ("MVM-AI") powered by third-party technologies (e.g. OpenAI).
No guarantee of accuracy: Artificial intelligence can make mistakes. Information, summaries or messages generated by MVM-AI may be inaccurate, incomplete or misleading. All outputs should be verified before you rely on or send them.
User responsibility: You are solely responsible for any actions taken based on AI advice. The Provider accepts no liability for errors in your shift planning caused by AI suggestions.
5. Privacy
Your use of the App is also subject to our Privacy Policy for MVM Shift Planner. By using the App you consent to the data processing described therein, including the transfer of data for AI processing and iCloud synchronisation.
6. Advertising (Free Version)
The free version of the App is financed through advertising from Google AdMob. The Provider is not responsible for the content of third-party websites or services advertised within the App.
7. Limitation of Liability
To the extent permitted by law, the App is provided "AS IS" and "AS AVAILABLE" without any warranty of any kind.
No liability for data loss: The Provider accepts no liability for the loss of shift data, notes or settings. It is recommended to use the iCloud backup feature (Pro) or regular manual exports.
Liability cap: In no event shall the Provider's total liability for all damages exceed €50.00 or the amount you have paid for the App in the last 12 months, whichever is greater.
8. Termination
These Terms remain in effect until terminated by you or the Provider. Your rights under these Terms terminate automatically if you violate any of the provisions. Upon termination you must cease all use of the App and delete all copies.
